The “Customer” means the person making the purchase from the Seller

The “Seller” means The Cabinet Door Shop Ltd trading as Rigid Kitchens Online

The “Contract” means the terms and conditions listed below plus any other special conditions or agreements confirmed by the Seller in writing.

You the Customer

By placing an order through our site, you are letting us know that you are at least 18 years old, resident in the United Kingdom and that you are legally capable of entering into binding contracts.

Pricing & payment

All prices quoted are in UK sterling and include VAT and delivery. The price of the products will be as quoted on our site unless an obvious error has occurred. If the pricing error is obvious and unmistakable and could have been reasonably recognised by you as an error, we do not have to provide the products to you at the incorrect price. Product prices include VAT  and delivery where specified and all prices will be confirmed in our confirmation to you.  Full payment is required on order prior to the agreed delivery date. If the cabinets are bespoke i.e. painted in a colour chosen by you, then the balance will be due prior to production.  Payment for all products can made by credit or debit card and these payments can be taken over the telephone.  Initial payment can be made through the website. We accept most major credit and debit cards but please check website prior to ordering. We can also accept payment by Paypal, cheque or BACS transfer. Please note, however, that if paying by cheque or BACS then the order is not accepted/processed until the funds have cleared in our account.  Product prices are liable to change at any time, but changes will not affect orders already confirmed in writing by us.  All products remain the property of  Rigid Kitchens Online until full payment is made.  Please note that all orders are the liability of the customer. It is the customer’s responsibility to check that anything ordered is correct and is fit for purpose.

Samples/quotations

Samples are available to order from our website. Please note, however, that they are not provided to give any indication of the quality, size or colour of the products which are for sale on our site.   Samples are subject to a small charge of £9 including VAT and delivery which will be charged to you at the time the sample is ordered unless already stated if they are free. Charges for samples are visible on the website. Such charges will be refunded either when a full order is made and confirmation is sent or when they are returned to the Seller if charges are applicable. These samples must be returned to us in good and saleable condition for any refund to be made.  Any quotation given is not binding and is quoted on the basis that a binding contract shall apply only once an order is placed and accepted by us in writing. We reserve the right to extend or lessen the validation period of 30 days and we will confirm in writing if we choose to do so.

The Contract

After placing an order, you will receive an e-mail from us acknowledging that we have received your order.  All orders are subject to acceptance by us, and we will confirm such acceptance to you by sending you an e-mail that confirms that the order has been accepted which will include an order number. Please quote this order number in all subsequent correspondence between us. The contract between us will only be formed when we send you the acceptance.

The contract will relate only to those products whose acceptance we have confirmed in writing. Please note that subject to availability there might be more than one acceptance of order, and therefore order number.  Please note that some of the products belong to third party sellers and therefore, the resulting legal contract is between you and that third party seller, and is subject to the terms and conditions of the third party seller. We would suggest, therefore, that you carefully peruse the third party seller’s terms and conditions prior to ordering. This means, therefore, that we shall not be liable for any losses that result from the failure of the third party although we will, of course, endeavour to assist in any way possible. If you are contracting as a consumer, you may cancel a Contract at any time within seven working days, beginning on the day of order and deposit. If, however, the products are personalised or made to order, if this process has already or is already taking place then this might not be possible and the full cost could be incurred.

Again, please note that all orders are the liability of the customer. It is the customer’s responsibility to check that anything ordered is correct and is fit for purpose.

Returns/Warranties

To cancel a contract, you must inform us in writing including email. You must also return any samples and products to us as soon as reasonably practicable, and at your own cost. These samples must be returned in good and saleable condition or these will remain chargeable. Please ensure if returning products to us that the necessary insurance is taken out to minimise your costs should any damage occur.

If, however, the products have been made to a bespoke finish/design you do not have the right to cancel the contract, please contact Rigid Kitchens Online to discuss.  Upon delivery of the products you are responsible for inspecting the products and reporting to us within 48 hours of any alleged defect, fault or error prior to the products are used or fitted. All defects/errors to be reported must be made within this time and prior to fitting as the company shall have no liability if this time frame is not adhered to.  If you return an order to us because you have cancelled the contract between us we will process the refund due to you as soon as possible. This is normally within 10 days of cancellation.  Please check the individual warranties for accessories etc. but the cabinets, hinges and drawer runners have a 10 year warranty and the doors and drawer fronts for 5 years. All appliances and sink products are covered by individual product guarantees.  Please note, however, that all warranties /guarantees apply only if:

1. products only being used for domestic use

2. products being correctly installed Guarantees/warranties do not apply if:

a. there has been wilful damage, accident or negligence by you or any third party

b. if you use the products in a way that is not recommended

c. you fail to follow our instructions i.e. fitting a kitchen on a recently plastered wall

d.you carry out alterations/repairs without our prior written approval

e. incorrect instructions were submitted by you at time of order

Guarantees/warranties do not cover fair wear and tear

Our promise to you is that any product purchased from us through our site will be fit for purpose and conform to its description.
Availability &  delivery. Our delivery is made by a dedicated two man delivery team and we endeavour to deliver your order on the delivery date sent to you in the despatch confirmation. If, however, there are forces outside of our control (force majeure) which includes but is not limited to: Industrial action/strikes, terrorist attack, riot or invasion Pandemic or epidemic Fire, explosion, flood or other natural disaster Impossibility of use of public/private transport/communication then the performance under contract is deemed to be suspended. In some circumstances third party sellers will be delivering their own products due to stock issues etc. We shall not be liable for any delay or failure of delivery in these circumstances.  Delivery dates are not guaranteed but we aim to be as specific and time-bound as possible. If you fail to take delivery of an order on the specified delivery date then delivery charges will apply. If goods have to be stored then a further charge will be made and is payable on the next delivery. If you have not taken delivery of the products within two weeks of our notifying you that they are ready, we may resell and pay the difference back to you. If there is a shortfall, however, after expenses are taken into account, then you will be invoiced the difference.

Our refunds/returns policy 

If you return products to us because you consider that the products are defective and we have agreed to collect them from you on a date agreed between us or we ask you to return the products to us at our cost or we agree that you can provide suitable photographic evidence, we will examine the returned product or evidence as soon as possible and will notify you of our intentions. This could result in a full refund, partial refund, replacement of products or repair of such products. We will usually process any refund due to you as soon as possible which is normally within 30 days of the day we confirmed to you via e-mail that you were entitled to a refund. We will refund the price of any defective product in full along with any delivery charges.</span></p><p class=”p2″><span class=”s2″>The law states that we must refund any money received from you using the same method originally used by you to pay for your purchase.</span></p>

Appliances/Accessories

Please note, we are here to help you. Call our customer services department between 9:30am – 5pm Monday to Friday and we’ll do our best to sort it for you. If you have ordered and received an appliance and it isn’t working properly, the manufacturer is often the best person to help. We will be able to pass you over to them and they will deal with it for you.  It is important that you keep a note of your serial number before your appliance is installed. This makes it easier for the manufacturer to help you.

Our liability

If we fail to comply with these terms and conditions, we shall only be liable to you for the purchase price of the Products and, any losses that you suffer as a result of our failure to comply. Please note that the door finishes are painted and the cabinets are a matching MFC board. Please bear in mind that these materials have different finishes.We will not be liable for losses that result from our failure to comply with these terms and conditions that fall into the following categories even if such losses result from our deliberate breach: loss of income or revenue, profits, data or loss of business; Nothing in this agreement excludes or limits our liability for:

a.  death or personal injury caused by our negligence;

b. fraud or fraudulent misrepresentation;

c. any breach of the obligations implied by section 12 of the Sale of Goods Act 1979 or section 2 of the Supply of Goods and Services Act 1982;

d. defective Products under the Consumer Protection Act 1987; or

e. any other matter for which it would be illegal for us to exclude or attempt to exclude our liability.

You are responsible for installing the products in your property and we will not be responsible for any damage caused to the products or your property arising during the course of installation. As already stated, if you have freshly plastered walls then please allow time for this to dry out and stabilise or any guarantee would be negated. Please check and allow adequate room for ventilation

Written communications

Applicable laws require that some of the information or communications we send to you should be in writing. When using our site, you accept that communication with us will be mainly electronic. We will contact you by e-mail or provide you with information by posting notices on our website. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing. This condition does not affect your statutory rights.

Our site provides you with the opportunity to send to us any special requirements or instructions you might have. Please be aware that all measurements must be exact as Rigid Kitchens Online cannot be held responsible for any losses due to incorrect measurements. Consumers cannot cancel, return or obtain refunds for items that are made to the customer’s own specification or size once these items have gone into production. It is essential that you peruse your kitchen order and are completely satisfied with it prior to ordering online.

When placing an order for a bespoke painted kitchen please be aware that it is not possible to cancel or return orders once these have gone into production. We strive to attain consistency and it would be imprudent to guarantee an exact colour match between orders due to batch variances. The paint colours on our sample doors are indicative of the colours in our bespoke painted range but may not be exact due to batch variances mentioned above.

Cancellation

We reserve the right to cancel the Contract between us if:

Our suppliers have insufficient stock to deliver the Products you have ordered or such Products have been discontinued;

One or more of the Products you ordered was listed at an incorrect price.<

If we do cancel your Contract we will notify you by e-mail and will re-credit your account by any sum deducted by us from your credit card as soon as possible but in any event within 30 days of your order. We will not be liable to pay any additional compensation for disappointment suffered.

Transfer of rights & obligations 

The contract between you and us is binding on you and us and on our respective successors and assignees. The seller may assign the contract or any part of it to any person, firm or company but the customer shall not have this entitlement.
21. Severability If any court or competent authority decides that any of the provisions of these terms and conditions or any provisions of a Contract are invalid, unlawful or unenforceable to any extent, the term will, to that extent only, be severed from the remaining terms, which will continue to be valid to the fullest extent permitted by law.

Nothing in this clause limits or excludes any liability for fraud.

23. Our right to vary these terms & conditions  We have the right to revise and amend these terms and conditions from time to time to reflect changes in market conditions affecting our business, changes in technology, changes in payment methods, changes in relevant laws and regulatory requirements and changes in our system’s capabilities.  You will be subject to the policies and terms and conditions in force at the time that you order Products from us, unless any change to those policies or these terms and conditions is required to be made by law or governmental authority (in which case it will apply to orders previously placed by you), or if we notify you of the change to those policies or these terms and conditions before we send you the Despatch Confirmation (in which case we have the right to assume that you have accepted the change to the terms and conditions).

Law & jurisdiction English or Scottish Law shall govern all contracts for the purchase of items from this website and any dispute shall be subject to the jurisdiction of the English or Scottish Courts. If, therefore, any provision of these terms and conditions should be deemed unlawful, void or for any reason unenforceable then that provision shall be deemed severable and will not affect the validity and enforceability of the remaining provisions

Electronic Communications By providing your contact details to Rigid Kitchens Online, you are consenting for us to contact you by email and SMS to let you know about your order delivery or changes to order or delivery. Occasionally we may contact you with any offers which we feel may be of interest to you. You can unsubscribe from both texts and emails if you so wish.

Minimum order value

We have a minimum order value of £1000 for complete kitchen orders (furniture only). This is due to the manufacturing process of making each kitchen to order. This does not affect any orders for extras or such like which can be made through our website. If the order value is under £1200 then a discretionary delivery charge may be applicable.

Our right to vary these terms & conditions Although we have the right to vary these terms and conditions at any stage to reflect the changes in our business, technology, payment methods and other variances, please note that you will be subject to the policies and terms and conditions in force at the time that you order products from us.
